APPROVAL OF REPORTING RELATIONSHIPS AND SUPERVISORY
STRUCTURE FOR DUAL EMPLOYMENT SITUATIONS

  • The following resolution was adopted:
    WHEREAS the Virginia Conflict of Interest Act was amended by the 1993 General Assembly, to be effective July 1, 1993, to permit the dual employment of immediate family members by public institutions of higher education that would otherwise be prohibited by this statute, subject to the following conditions:
    (i) the officer or employee and the immediate family member are engaged in teaching, research, or administrative support positions at the educational institution, (ii) the governing board of the educational institution finds that it is in the best interest of the institution and the Commonwealth for such dual employment to exist, and (iii) after such finding, the board establishes and oversees the implementation of reporting relationships and a supervisory structure to ensure that the officer or employee, or the immediate family member, does not supervise, evaluate, or otherwise participate in personnel decisions regarding the other;
  • WHEREAS the Department of English and the Dean of the Faculty of Arts and Sciences have recommended that Ms. Lotta L. Casteen be employed as a member of the faculty to teach courses; and
  • WHEREAS President John T. Casteen, III, is an officer of the University and would accrue a personal interest in his spouse's employment contract;
  • RESOLVED that the Board of Visitors finds it in the best interest of the University of Virginia and the Commonwealth to employ Ms. Lotta L. Casteen as a member of the faculty to teach courses in the Department of English;

  • RESOLVED FURTHER that the reporting relationship and supervisory structure for Ms. Lotta L. Casteen shall be as follows:
    • (a) All personnel matters will be handled in accordance with customary practices, with the faculty member reporting to the department chair, and the chair and the Dean of the Faculty of Arts and Sciences making recommendations regarding salary, faculty rank, performance evaluations, and other personnel matters to the Vice President and Provost;
    • (b) The Vice President and Provost shall act in the stead of the President for all matters that would ordinarily require the President's action and will present to the Board of Visitors those matters which require its action.
