APPROVAL OF MARINERS' MUSEUM GROUND LEASE

  • The following resolution was adopted:
  • WHEREAS, the charter that created the Mariners' Museum provides that in the event it should fail in its purpose, all of its lands, title, and interest revert to the University of Virginia;
  • WHEREAS, the Mariners' Museum, in exchange for ample consideration, has granted a ground lease of a portion of its property to a developer for a term of sixty (60) years for the purpose of developing a continuing care retirement community;
  • WHEREAS, the Mariners' Museum, as lessor, has requested that the University of Virginia confirm its concurrence with the ground lease transaction so that if the foregoing contingency should occur, the reversion of Mariners' Museum property to the University will be subject to the outstanding ground lease with the developer;
  • AND WHEREAS, the concurrence of the University was similarly sought and obtained in 1989 with respect to the Mariners' Museum ground lease of another portion of its property to the Riverside Hospital;
  • NOW THEREFORE BE IT RESOLVED that the Board of Visitors hereby affirms its concurrence of the foregoing ground lease transaction for the limited purpose so stated.
