APPROVAL OF AMENDMENTS TO THE GUIDELINES FOR STUDENT ACTIVITIES CURRENT FUND ALLOCATION

  • The following resolution was adopted:
  • WHEREAS, current policy restrictions regarding the funding of "political activities" appear ambiguous in certain respects, and consequently require clarification to enable the Student Council to determine funding allocations consistent with currently applicable constitutional and legal constraints;
  • NOW THEREFORE BE IT RESOLVED that the following funding restrictions contained in the Guidelines for Student Activities Current Fund Allocation be and are hereby deleted:
  • "No monies from these funds shall be given:
  • 5. for activities which would jeopardize the University's status under Section 501 (3)(c) of the Internal Revenue Code.
  • 6. for political activities or activities sponsored by political organizations. Political activities are, in general, those normally engaged in by political parties or special interest groups, such as electioneering or lobbying. Electioneering shall include the broad range of those activities incidental to the promotion of partisan political ideas or programs and their representatives. Lobbying shall include any activity whose purpose is to procure or prevent, the acceptance of any social, economic or political theory as an operating principle or policy. This shall not include engaging in non-partisan analyses, study, or research or making those results available to the public. A public interest organization will not fail to meet the test merely because it advocates, as an insubstantial part of its activity, the adoption or rejection of legislation."

  • BE IT FURTHER RESOLVED that the following funding restrictions be and are hereby substituted:
  • "No monies from these funds shall be given:
  • 5. for political action purposes, i.e. lobbying or electioneering activities. Lobbying includes any activity the principal purpose of which is to influence the passage or defeat of specific legislation. Electioneering encompasses participating or intervening in any political campaign on behalf of or in opposition to any candidate for public office. These restrictions are not intended to preclude funding of any otherwise eligible student organization which: (1) advocates, as an incidental or insubstantial part of its activities, the adoption or rejection of legislation; (2) engages in nonpartisan analysis, study, or research, and makes the results available to the public; or (3) espouses particular positions or ideological viewpoints, including those that may be unpopular or are not generally accepted.
  • 6. for activities which would jeopardize the University's status as an organization to which contributions are deductible under Section 170 of the Internal Revenue Code. If a governmental inquiry or audit is initiated as a result of an activity of a particular organization that may lead to the imposition of excise taxes or otherwise impair the University's tax-exempt status, the University may suspend, withdraw or discontinue funding to that organization after notice and an opportunity to be heard."
  • BE IT FINALLY RESOLVED that the foregoing amendments to the Guidelines for Student Activities Current Fund Allocation shall apply to all student organization funding requests that are pending on, or are made after, July 1, 1989.
