LAMBETH LANE EASEMENT

  • The following resolution was adopted:
  • WHEREAS the University of Virginia owns Lambeth Lane, which intersects the western line of Rugby Road immediately south of and adjacent to the property known as 503 Rugby Road, Charlottesville, Virginia; and
  • WHEREAS the Kappa Kappa Gamma Fraternity, an Ohio non-profit corporation, purchased the property known as 503 Rugby Road, and through the Epsilon Sigma House Corporation of Kappa Kappa Gamma is planning to build on the property a sorority house which will house 35 members and a house-director; and
  • WHEREAS the sorority plans to build dining and kitchen facilities for serving its residents and additional members; and
  • WHEREAS Charlottesville zoning regulations require that parking spaces be provided on the property of the sorority and the only possible access for such parking is from Lambeth Lane; and
  • WHEREAS the sorority has requested that the University grant it an easement of ingress and egress over Lambeth Lane to serve the sorority house at 503 Rugby Road;
  • NOW THEREFORE BE IT RESOLVED by The Rector and Visitors of the University of Virginia that the proper officers of the University be, and they are hereby authorized to execute and deliver a deed of easement of ingress and egress to the Kappa Kappa Gamma Fraternity, an Ohio non-profit corporation, or its successors in title, over Lambeth Lane to serve the property, known as 503 Rugby Road, Charlottesville, Virginia, for as long as such property is used for a sorority house.
