AMENDMENT OF REAL ESTATE PURCHASE AGREEMENT

  • The following resolution was adopted:
  • WHEREAS, the Real Estate Purchase Agreement dated March 26, 1987, related to the Sears Building, parking garage and other related improvements situated in Chattanooga, Hamilton County, Tennessee, has been approved by the Executive Committee of the Board of Visitors; and
  • WHEREAS, it is now the intent of the Board of Visitors to amend that agreement;
  • RESOLVED that paragraph "f" as originally stated in the Real Estate Purchase Agreement be deleted and that a new paragraph "f" as stated below be approved and included as part of the Real Estate Purchase Agreement, dated March 26, 1987:
  • The Seller's certification by a licensed engineer that the building does not contain asbestos or other such classified materials. The University will pay one-half (50%) of the cost of removal of asbestos, if any, but the University's obligation under this item shall in no case exceed $50,000.
