CHANGES IN THE UNIVERSITY RETIREMENT POLICY

The General Assembly of Virginia by bill signed into law on March 27, 1987, amended 51.111.54 of the Code of Virginia by removing any reference to a mandatory retirement age.

  • The following resolution was adopted:
  • RESOLVED that the resolution adopted by the Board on October 7, 1978 dealing with University Retirement Policy, is hereby revoked in its entirety;
  • RESOLVED FURTHER that as of January 1, 1987 there shall be no mandatory retirement age for faculty members, research personnel, athletic coaches and any other employees of the University of Virginia, whether they be classified or unclassified, and whether or not they are exempt from coverage under the State Personnel Act;
  • RESOLVED FURTHER that, consistent with 51-111.54(b) as amended, subsequent to any employee's normal retirement age, that the appropriate Vice President or (in the case of persons reporting to him or her) the President, may provide for compulsory retirement upon a determination that age is a bona fide occupational qualification reasonably necessary to the normal operation of the University or that the employee is incapable of performing his duties in a safe and efficient manner;
  • RESOLVED FURTHER that the University's retirement policy as set forth in this resolution shall supersede all previous mandatory retirement policies affecting University employees.
