RESOLUTION CONCERNING AMENDMENT TO STANDARDS OF CONDUCT

  • The following resolution was adopted:
    RESOLVED that in order to update and to portray more clearly to the community prohibited acts of conduct for which members of the student body are subject to discipline under the University Judiciary Committee, that the Standards of Conduct be amended as follows:

  • Standard 1:

  • Current Wording: Physical abuse of any person on University-owned or regulated property or at University-sponsored functions, or conduct which threatens or endangers the health or safety of any such persons.
  • Proposed Revision: Physical or sexual assault of any person on University-owned or leased property or at University-sponsored or supervised functions, or conduct which threatens the health or safety of any such person; or the physical or sexual assault of any University student, faculty member or employee at the local residence of any student, faculty member or employee within the city of Charlottesville or Albemarle County.
  • Standard 2:

  • Current Wording: Damage to property of the University or of a member of the University or visitor to the University.
  • Proposed Revision: Damage to University-owned or leased property or to property of a University student, employee, faculty member or visitor occurring on University-owned or leased property.
  • Standard 3:

  • Current Wording: Unauthorized entry into or occupation of University facilities which are locked, closed to student activities, or otherwise restricted as to use.
  • Proposed Revision: Unchanged.
  • Standard 4:

  • Current Wording: Intentional disruption or obstruction of teaching, research, administration, disciplinary procedures, or other University activities, or of the authorized activities on University property.
  • Proposed Revision: Intentional disruption or obstruction of teaching, research, administration, disciplinary procedures, other University activities, or activities authorized to take place on University property.

  • Standard 5:

  • Current Wording: Unlawfully blocking or impeding normal pedestrian or vehicular traffic on or adjacent to University property.
  • Proposed Revision: Unchanged.
  • Standard 6:

  • Current Wording: Violation of rules governing residence in University-owned, operated or regulated property.
  • Proposed Revision: Violation of rules governing residence in University-owned or leased property as stated in The Record.
  • Standard 7:

  • Current Wording: Alteration, fabrication, or misuse of University documents, records, or identification cards, or like acts which adversely affect the University's education interest.
  • Proposed Revision: Alteration, fabrication, or misuse of, or obtaining unauthorized access to, University identification cards, other documents, or computer files or systems.
  • Standard 8:

  • Current Wording: Disorderly conduct on University-owned, operated, or controlled property or at University-sponsored functions. Disorderly conduct shall include acts which violate the rights of others, which tend to breach the peace, or which are deemed lewd, indecent or obscene. "Conduct" may also include expression which exceeds the bounds of constitutionally-protected speech.
  • Proposed Revision: Disorderly conduct on University-owned or leased property or at a University-sponsored function. Disorderly conduct is defined to include acts which breach the peace or are lewd, indecent, or obscene, and which are not constitutionally-protected speech.
  • Standard 9:

  • Current Wording: Violations of University policies or of University regulations, including regulations concerning the registration of student organizations and the use of University facilities.
  • Proposed Revision: Violation of University policies or of University regulations as described in The Record including regulations concerning the use of University facilities.

  • Standard 10:

  • Current Wording: Any violation of federal, state, or local law if such directly affects the University's pursuit of its proper educational purposes.
  • Proposed Revision: Unchanged.
  • Standard 11:

  • Proposed Standard: Intentional conduct which violates the rules of confidentiality, or which obstructs the operations of the Honor Committee, the University Judiciary Committee, or any subsidiary body.
  • Standard 12: (Old Standard 11)

  • Current Wording: Failure to comply with directions of University officials acting under provisions 1 - 11 set out above. This shall include failure to give identity in situations concerning alleged violations of sections 1 - 11.
  • Proposed Revision: Unchanged, other than numeration.
