WILLIAM J. RUCKER WILL MATTER:

The matter for special consideration was the decision of the Circuit Court for Baltimore
County, Maryland, on the petition filed by the Safe Deposit and Trust Company of Baltimore,
Executor and Trustee under the Last Will and Testament of Lucy James Dun, vs. William James Rucker and Sallie
Rucker, his wife, Jane James Cook, widow, Ex Parte, in the matter of the Estate of Lucy James
Dun, Dec'd, alleging that the trust created under the will is now terminated and praying for
instructions and directions as to the final distribution of the corpus thereof, sustaining the
petition of the plaintiff. Mr. C. Venable Minor, one of the Attorneys for the Executors of the
Will of William James Rucker, was present and, and together with the members of the Board, entered
into a general discussion of the decision of the Circuit Court of Baltimore County, and desirability
of appeal therefrom. The matter was disposed of in the following motion by Senator Weaver,
adopted:

RESOLVED, By the Board of Visitors of the Rector and Visitors of the University of
Virginia that the Attorneys for the Executors of the Will of William J. Rucker be
and they are hereby requested to appeal the decision of the Circuit Court of Baltimore
County, Maryland, in the construction of Mrs. Dun's Will to the Court of Appeals
of the State of Maryland.

This resolution is passed pursuant to the financial arrangement set forth in a letter
from Charles Markell, C. Venable Minor and John S. Battle, to Messrs. W. Allan Perkins
and George Pausch, Under date of October 22, 1943.
