RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN PROPERTIES FOR
THE HEALTH SCIENCES CENTER PROJECT

  • The following resolution was adopted:
  • WHEREAS, during the 1990 General Assembly Session the University of Virginia received authorization, under the appropriation for the planning for Jordan Hall Addition, to proceed with the purchase of the properties required for the future expansion of Jordan Hall and the relocation of Lane Road subject to approval of the Department of General Services; and
  • WHEREAS, in furtherance of this public project the University has obtained appraisals, and engaged in preliminary negotiations with the owners of the following four improved properties: 1300-1306 Lane Road, and shown on the City of Charlottesville tax map as Section 11, parcel 137; 1308 Lane Road, and shown on the City of Charlottesville tax map as Section 11, parcel 135; 1310 Lane Road, and shown on the City of Charlottesville tax map as Section 11, Parcel 134; and 305 Park Place, and shown on the City of Charlottesville tax map as Section 11, Parcel 136;
  • NOW, THEREFORE, BE IT RESOLVED that the Vice President for Business and Finance be and hereby is authorized, on behalf of the Rector and Visitors, to acquire by negotiations the above-identified properties for such consideration, either in the form of cash or by exchange of equivalent property, that is consistent with the appraisals of the fair market value for each such parcel of property and subject to the approval of the Department of General Services; and
  • BE IT FURTHER RESOLVED that the Vice President for Business and Finance is also authorized to take such action and execute such documents that are reasonably necessary to effectuate the acquisition of the above properties, including any exchange agreement that is deemed financially advantageous to the University; and to seek and obtain from the City of Charlottesville its approval of closure of that portion of Lane Road, and the transfer thereof to the University, necessary to construct the Jordan Hall Addition;
  • BE IT FINALLY RESOLVED that in the event bona fide efforts for the negotiated purchase of any of the above-identified properties prove ineffectual, the Vice President for Business and Finance is authorized to institute condemnation proceedings to acquire any such properties for the public necessity and purpose noted herein, pursuant to the procedures prescribed by law.
