RESOLUTION APPROVING THE ESTABLISHMENT OF THE UNIVERSITY OF
VIRGINIA SUBSTANCE ABUSE STUDIES FOUNDATION

  • The following resolution was adopted: (Mr. Leigh Middleditch abstained from voting [see report below]):
  • WHEREAS, the Vice President for Health Sciences has approved the submission of a grant proposal to the U.S. Department of Education to operate the Southeast Regional Center for drug free schools and communities; and
  • WHEREAS, the Vice President for Health Sciences has recommended the establishment of the University of Virginia Substance Abuse Studies Foundation (the Substance Abuse Studies Foundation) to administer this federally supported program; and
  • WHEREAS, it is further proposed that the Substance Abuse Studies Foundation be managed and operated as a subsidiary of the University of Virginia Health Services Foundation (the Health Services Foundation); and
  • WHEREAS, the activities of the Substance Abuse Studies Foundation will include the evaluation and enhancement of existing educational and training programs relating to alcohol and other drug abuse at the primary, secondary and collegiate levels throughout the Southeastern Region of the United States, as well as the provision of teaching services at the undergraduate, graduate, postgraduate, and continuing education levels in conjunction with the Health Sciences Center, the Curry School of Education, and other components of the University; and
  • WHEREAS, the Board of Visitors has reviewed the purpose of the Substance Abuse Studies Foundation, its proposed organizational format, the scope of its activities, and the provision for representation of the Board of Visitors or a senior administrator of the University designated by the Board of Visitors on the Substance Abuse Studies Foundation's governing board; and
  • WHEREAS, the requirements of the Management Principles for Relationships with University-Related Foundations (Principles) and Guidelines for University-Related Foundations (Guidelines) have or will be met prior to establishment of the Substance Abuse Studies Foundation;
  • NOW, THEREFORE BE IT RESOLVED that the University of Virginia Substance Abuse Studies Foundation be and hereby is, approved subject to a determination by the Vice President for Business and Finance that the proposal is financially feasible and the requirements of the Principles and Guidelines have been met; and

  • NOW, THEREFORE BE IT FURTHER RESOLVED that the University be, and hereby is, authorized to enter into a written agreement, reviewed and approved by the Vice President for Business and Finance and the General Counsel, relative to the provision and exchange of services, resources, and facilities between the University and the Substance Abuse Studies Foundation for the establishment and operation of the Substance Abuse Studies Foundation.
  • Note: Mr. Leigh B. Middleditch, Jr., disqualified himself from voting, participation, or acting in any manner on this resolution because of his relationship to the University of Virginia Health Sciences Foundation.
