REPORT BY THE RECTOR ON THE TELEPHONE POLL OF THE EXECUTIVE
COMMITTEE ON FEBRUARY 27, 1973

The Rector reported on the telephone poll of the Executive Committee authorizing Mr. A. Ward Sims to arrange for the sale of property willed to the University by Mr. John C. Airhart. In accordance with Section 3.1 of the Manual of the Board of Visitors, 1966, the Executive Committee acting for The Rector and Visitors, unanimously adopted the following resolution:

  • RESOLVED that the Executive Committee of The Rector and Visitors of the University of Virginia, said Rector and Visitors being sole legatee and devisee under Paragraph II of the Will of John C. Airhart, the said Will being executed on 23 June 1972 and the said testator having died on September 18, 1972, hereby consents to the exercise by A. Ward Sims, Executor nominated in Article III of the aforesaid Will, who qualified on 27 September 1972 in the Office of the Clerk of the Circuit Court of Fairfax County, of his power of sale conferred by Paragraph (b) of Virginia Code (1950) Section 64.1-57, which section is incorporated by reference unto the aforesaid Will, at such times and upon such terms and conditions as the aforesaid executor in his sole discretion deems wise, the following tracts of land of which The Rector and Visitors is devisee:
  • 1. Lots 1A, 1B, 12A and 12B in Mayfair Subdivision, Leesburg, Virginia.
  • 2. House and lot located on 10th Street, Purcellville, Virginia.
  • AND BE IT FURTHER RESOLVED that the interests in said tracts devised to The Rector and Visitors of the University of Virginia by said Will be conveyed to such grantees, and upon such terms and conditions, as the aforesaid A. Ward Sims, Executor, in his sole discretion shall deem wise, and the Comptroller and Secretary are hereby authorized to execute such deeds and other documents and assurances as may be necessary to effect such conveyances, and the grantees in each case shall not be required to look to the application of the proceeds.
