"Avoid," the dentist said, is
the crucial word in his case.
"In his instructions to the jury
the judge in my case said it was
acceptable for a man to
exhaust every legal means to
avoid the draft. That was my
strategy-I always insisted on
legality. I didn't advocate
illegal means of evading it,
which is what the government
claims." Dr. Bender noted.

He only put braces on the
teeth of men who needed
orthodontia, Dr. Bender
explained, citing a statement
by the American Dental
Association that 90 per cent of
the adult population need such
treatment.
