Madison College readmitted a third
suspended student to the institution Tuesday
and a fourth student denied readmission
was promised legal aid by the American
Civil Liberties Union.
William Massis, 19, of Alexandria, was
readmitted after being suspended for his
part in a peaceful demonstration at the
college in April. Lewis Sword and Judy
Reed were readmitted Monday.
Application was denied to a fourth student.
Jay Rainey, who applied for readmission with
Sword and Miss Reed.
Following the spring semester of 1968. Mr.
Rainey was first denied readmission. After this
incident U.S.District Judge Ted Dalton held
that Mr. Rainey should be reinstated under a
consent order.
The college and Mr. Rainey are back in
Western District Court, with the college maintaining
that Mr. Rainey should not be readmitted
because he violated the terms of the
consent order.
Two college rules invoked to suspend the
students involved in the demonstration were
recently ruled unconstitutional by U.S.District
Court Judge Robert R. Merhige, Jr.
ACLU lawyer John W. Lowe said Tuesday,
"It is our feeling that Jay Rainey is supposed to
be in school under Judge Merhige's order. "Mr.
Lowe also said, "We are proceeding with all the
legal remedies we can to get him back in
school."
It was discovered by The Cavalier Daily
yesterday that John Lowe, the ACLU lawyer in
the Madison College decision and Mr. Rainey's
lawyer, intends to bring the college's decision
before Federal Judge Merhige next week. Mr.
Lowe may seek a court injunction to have Mr.
Rainey admitted.
